GENERAL TERMS AND CONDITIONS

SCOPE OF APPLICATION
  • These General Terms and Conditions (GTC) govern all contracts concluded on the basis of offers from KARE-India (hereinafter referred to as “KARE”) on “kare.in“.
  • In these GTC, “Consumers” are defined as natural persons whose contractual purpose cannot be attributed to a commercial, self-employed, or freelance activity. “Entrepreneurs” are natural or legal persons or legal partnerships who conclude contracts for commercial, self-employed, or freelance purposes. “Customers” within the meaning of these GTC include both consumers and entrepreneurs.
  • All transactions and deliveries shall be governed solely by these GTC. Customer terms and conditions do not apply in business dealings with KARE-India, even if KARE does not expressly object to them or performs services without objection. This also applies if the customer prescribes a particular form for objecting to such terms. Deviations from these conditions are only valid if explicitly agreed upon in writing between KARE and the customer.
REGISTRATION ON WWW.KARE.IN
  1. To place an order, customers must provide their personal data, insofar as it is necessary for order processing, customer service, and any future warranty claims. There is no entitlement to registration in our system. Only persons with full legal capacity are eligible. Upon explicit request, the customer must provide a copy of their ID.
  2. The required data must be provided truthfully and completely. If a customer registers and creates a permanent customer account, they are obliged to update their information in the account in the event of changes.
  3. During registration, the customer selects a personal username and password. The username must not violate third-party rights, naming and trademark laws, or common decency. The customer must keep the password confidential and not share it with third parties. If there are indications of misuse of the account, the customer must inform KARE immediately.
  4. Customers are not allowed to maintain multiple accounts. In the event of a violation, KARE reserves the right to delete duplicate registrations.
  5. Aside from agreeing to these GTC, registration entails no obligation for the customer. It does not constitute a purchase obligation. Customers may request deletion of their registration and data at any time by emailing:[email protected].
ORDER PROCESS
  1. The technical order process is as follows: The customer selects a product from the offerings on kare.in, specifies the quantity and, if applicable, the variant. By clicking “Add to Cart”, the item is placed in the cart. Additional items can be added in the same way. To proceed, the customer clicks “View Cart”.
    1. In the cart, the customer can review quantities, remove items, or continue shopping. Clicking “Proceed to Checkout” leads the customer to either log in or enter data for the order. The customer can:
      • Specify a different delivery address
      • Select the desired payment method
      • Choose the shipping method
      • Accept these GTC, including the legal right of withdrawal
      • Review and correct the order before submission
        The order can be saved or printed using the browser functions. The order is only binding when the customer clicks the “Buy” button.
    2. These GTC are available atkare.in under “Terms & Conditions” and can be printed or saved using the browser’s save function (e.g., “File” → “Save As” to save a PDF).
    3. Although the contract text is stored, it is not retrievable later. However, customers can print or save it before sending the order. Additionally, they may archive the order data by:
      • Downloading the GTC and saving the summary page at the end of the ordering process, or
      • Saving the automatic order confirmation and contract confirmation email sent by KARE, which includes order details and can be easily printed or stored.
    4. Customer order data is stored by KARE but is not directly accessible for security reasons. Registered customers have access to a password-protected account (“Customer Login”) to view past orders and manage address details.
CONCLUSION OF CONTRACT
  1. The presentation of goods on www.kare.in does not constitute a binding offer.
  2. Upon receipt of the order, a technical confirmation is immediately sent by email. This does not yet constitute acceptance of the order.
  3. A binding sales contract is concluded either through a separate confirmation email or by dispatching the goods within five days.
  4. Due to technical limitations, slight deviations from the product images (especially colour variations) on the website may occur and are acceptable within reasonable limits.
  5. Entry errors can be identified before checkout and corrected using the delete or edit functions.
PAYMENT TERMS

You can pay for your goods in various ways as set out below. Depending on the payment method you choose, additional costs and terms may apply.

Payment before or at delivery

  1. Credit card or debit card
    You can enter your payment details at the time you place your order using a valid credit or debit card (VISA ,Mastercard or such other option(s) as offered at our Online Store). The applicable amount will immediately be debited from your card. KARE India reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks.
  2. Cash on Delivery
    You may choose to pay by cash on delivery upon receipt of the goods, without any additional charges.
  3. EMI
    You may choose EMI as a payment method provided by various banks. Additional interest charges are applicable depending on the tenure and amount involved.
  4. UPI 
    You may choose to pay your order with UPI. The order value will be debited from the associated bank account when you have placed your order at the checkout page.
  5. NET BANKING
    You may choose to pay for your order via net banking. The order value will be debited from the associated bank account when you have placed your order at the checkout page.

Other
You will receive your receipt/tax invoice in the order delivered e-mail as well as in the order package delivered to you.

DELIVERY TERMS

So, when will my order arrive, you wonder? In the checkout view, before placing your order, you will be informed of the  estimated delivery time following our approval of your order. You can also find more information at Delivery Policy . If we approve your order, you will receive a shipping confirmation email containing all relevant information about your order. 

Even though we do our very best to deliver within the communicated time frame, delivery may sometimes take longer due to unexpected events. If your order does not arrive by the estimated time of delivery, please contact Customer Service and they will try their best to help you.

Sometimes life gets in the way, and you forget to respond to the carrier. That’s fine, we’ve all been there. However, if your order cannot be delivered after 3 attempts, the order shall be returned back to origin. No cost of return will be charged to you. Subsequently, your order amount will be automatically refunded to you in the original form of payment. 

KARE India reserves the right of not delivering the order to you in case of force majeure events, political unrest or other unforeseen circumstances.  

In case a delivery is temporarily not possible for your location or pin code on account of factors mentioned hereinabove, then your order will not be placed on our Online Store and you will be notified of the same.

Whereas in cases where your order is successfully placed on the Online Store  and subsequently your location or pin code becomes temporarily unserviceable, and in case the order has already been picked up by the delivery partner, then the delivery partner will attempt delivery with extended timelines if the specific dates for delivery are clearly available. However, if there are no specific timelines available, then the parcel will be returned to the origin and the refund process will be initiated.

In case your order is placed and if your location or pin code is not serviceable before the order has been packed, then KARE India will cancel your order and notify you through email and a refund shall be initiated to you upon such cancellation. 

AVAILABILITY; PROCUREMENT RISK; EXEMPTION FROM DELIVERY OBLIGATION; EXTENSION OF DELIVERY TIMES
  1. KARE does not assume any procurement risk, even for generic goods. KARE is only obliged to deliver from its existing stock or incoming goods already ordered from suppliers.
  2. KARE’s delivery obligation is void if it does not receive delivery from its suppliers despite proper procurement efforts and if KARE is not responsible for the unavailability. KARE will immediately inform the customer and refund any advance payments made.
  3. Delivery times may be extended appropriately in cases of force majeure, such as strikes, lockouts, government orders, shortages of energy or raw materials, transportation delays, or production disruptions not caused by KARE (e.g., fire, water, machinery breakdown). KARE will promptly inform the customer of the start and end of such events. If such a disruption continues for more than four weeks after the original delivery time, the customer may withdraw from the contract. No further claims, especially for compensation, shall arise.
RETURNS
  1. Changed your mind? No problem. You have the right to return any or all items in your order for any reason at all, by notifying us and returning the items within 15 days after your receipt of the order.
    1. You can return your order by simply placing a return request on the Online Store.
    2. You can go to My Orders on Your account page, then click on the order you want to return, select the item to be returned and submit the request. After that, please place the item you wish to return in the parcel the item was received in and hand it over to the delivery person assigned to carry out the pick-up
    3. If you want to arrange for the return of your item in an alternative manner, then please contact Customer Service. 
  2. Please include the correct and complete item in the parcel, otherwise we  will not be able to process your return. We want to highlight that you can only return items purchased from  the Online Store. You cannot return/ include items purchased from our physical stores in the parcel. 
  3. If you choose to make a return, we will refund you the order value except the cost of delivery. Furthermore, should you choose to keep certain items and only return parts of your order, the delivery cost will not be refunded.  
  4. The refund will be made to the same payment method you used to place the order, within 30 days of us receiving the items back. If you have not received your refund within 30 days, please contact Customer Service and we will help you.
  5. We will give you a full refund for any returned item provided that it is returned in the same condition as it was in upon your receipt.
  6. The right of withdrawal and return does not apply to products which are unsuitable for return, such as certain underwear, swimwear, piercing Jewellery, face masks, beauty products and cosmetics due to health protection or hygiene reasons.

 

WARRANTY
  1. If the delivered goods are defective, you are entitled, under statutory provisions, to request remedy (subsequent performance), withdraw from the contract, or reduce the purchase price.
  2. Entrepreneurs must report any obvious defects to KARE in writing within two weeks of receiving the goods; otherwise, warranty claims shall be excluded. Timely dispatch of the notice is sufficient to meet the deadline. The entrepreneur bears the full burden of proof for all requirements of the claim, especially the defect itself, the time it was discovered, and the timely notification of the defect.
  3. If a replacement delivery is made as part of the remedy, the customer is obligated to return the originally delivered goods to KARE within 30 days at KARE’s expense. The return of defective goods must comply with the relevant legal provisions. KARE reserves the right to assert claims for damages if the statutory conditions for doing so are met.
  4. The statutory warranty period for delivered goods istwo years from the date of receipt of the goods.
LIMITATION OF LIABILITY
  1. We shall be liable for intent and gross negligence. We are also liable for negligent breaches of duties, the fulfilment of which is essential for proper performance of the contract, the breach of which jeopardizes the achievement of the contract’s purpose, and on which the customer regularly relies. In the latter case, however, we shall only be liable for foreseeable, contract-typical damage. We shall not be liable for slightly negligent breaches of obligations other than those stated above.

The above exclusions of liability do not apply in cases of injury to life, body, or health. Liability under the Product Liability Act remains unaffected.

  1. Data communication over the internet cannot be guaranteed to be error-free or continuously available according to the current state of technology. Therefore, we do not accept liability for the uninterrupted availability of our online trading system.
